Handling Spousal Maintenance Claims

In Texas, the right to receive post-divorce spousal maintenance is limited. You may be entitled to receive maintenance if:

  • The marriage lasted for at least 10 years, or
  • Your spouse has been convicted of or placed on deferred adjudication for an act of family violence.

The court hearing your case will also consider other factors in determining whether you qualify to receive post-divorce spousal maintenance.

Generally, the Court can only order post-divorce spousal maintenance for a maximum of 3 years; however, if you are incapacitated or otherwise disabled, a spousal maintenance order can be longer in duration. To learn more, contact our office.
